These Terms form an agreement governing your use of toblues. Read them and the Privacy Policy before using the service. The service facilitates conversations between independent users; it does not endorse, supervise, or guarantee them.
1. Acceptance and electronic agreement
By checking the acceptance box, requesting a match, or otherwise using toblues, you confirm that you have read, understood, and agree to these Terms and acknowledge the Privacy Policy. If you do not agree, do not use the service. You consent to receive required notices electronically.
If you use the service for or on behalf of an organization, you represent that you have authority to bind it. No person may accept these Terms on behalf of another individual without lawful authority.
2. Eligibility and verification
- You must be at least 18 years old and legally capable of entering this agreement.
- You must control an eligible email account from a supported university and complete verification honestly.
- You may not sell, lend, transfer, automate, or share a verified session or verification code.
- You may not use another person’s email, misrepresent affiliation, bypass suspension, or operate coordinated duplicate sessions.
Verification indicates control of an email account at a moment in time. It does not prove identity, current enrolment status, age, honesty, safety, or endorsement by any university. toblues is independent and is not operated, sponsored, or endorsed by any listed university.
3. How the service works
toblues provides optional profile fields, preference-based one-to-one matching, text relay, peer-to-peer video connectivity, reporting, and moderation functions. Preferences are not guarantees. A match may be unavailable, delayed, incompatible, or ended without notice. Users are matched only within the university attached to their verified session. Text and video users are placed in separate queues, and immediate repeat matching with the same verified user is restricted.
Video uses WebRTC. Media generally flows directly between peers and may expose network information to the peer. toblues currently does not record video or audio. Either participant may nevertheless make an external recording beyond our control. Obtain any legally required consent before you record another person.
4. Prohibited conduct
You must use the service lawfully, respectfully, and only for genuine interpersonal communication. You must not:
- engage in grooming, sexual exploitation, sextortion, trafficking, solicitation of minors, or creation, possession, request, transmission, or promotion of child sexual abuse material;
- display nudity or sexual activity, send unwanted sexual content, expose another person to sexual conduct without consent, or use the service for commercial sexual services;
- threaten, stalk, harass, intimidate, blackmail, extort, dox, shame, discriminate, or promote hatred or violence;
- impersonate another person, misrepresent age or status, use deepfakes deceptively, or manipulate someone into disclosing intimate or confidential information;
- share another person’s personal information, image, recording, messages, or private communications without authority;
- commit or facilitate fraud, phishing, scams, money laundering, credential theft, malware distribution, unlawful gambling, controlled-substance sales, weapons offences, or other illegal activity;
- spam, advertise, recruit for unauthorized commercial schemes, scrape, index, harvest, or build contact or behavioural databases from users;
- probe, scan, attack, reverse engineer, overload, disrupt, evade limits, forge reports, inject code, exploit vulnerabilities, access another session, or interfere with moderation;
- use bots or automation to match, message, signal, report, verify, or create artificial traffic without written permission;
- upload or transmit content that infringes copyright, privacy, publicity, confidentiality, or other rights; or
- encourage, assist, or attempt any prohibited conduct.
“It was a joke,” mutual participation, anonymity, or conduct occurring off-platform does not prevent enforcement where the conduct creates risk to users or the service.
5. Safety, emergencies, and reports
Do not disclose home address, passwords, financial details, government identifiers, intimate images, or information that could endanger you. End a conversation that feels unsafe. Reports should be truthful, specific, and made for safety—not retaliation or manipulation.
Reports may preserve transcript and participant context. We may review retained chats, combine related reports, restrict sessions, preserve evidence, contact a user, and disclose information where lawful and reasonably necessary. Moderation is discretionary and imperfect; failure to act, delay, or a decision not to act is not an endorsement.
6. Your content and permissions needed to operate
You retain any rights you hold in messages and other content. You represent that you have the rights and lawful authority necessary to submit it. You grant toblues a limited, worldwide, non-exclusive, royalty-free licence to host, store, reproduce, transmit, format, secure, review, and disclose that content only as reasonably necessary to operate the service, maintain safety, investigate abuse, comply with law, enforce these Terms, and exercise the practices described in the Privacy Policy.
This operational licence ends when the content is deleted from active systems, except for reports, legal holds, backups, evidence, and records lawfully retained. It does not presently authorize sale of conversation content, targeted advertising from chats, or commercial AI training. Any future non-essential commercial or AI use requiring consent will use a separate opt-in process as described in the Privacy Policy.
Feedback and product suggestions may be used without restriction or compensation, provided we do not publicly identify you as the source without permission.
7. Privacy and retention
The Privacy Policy explains collection, retention, administrator review, service providers, international processing, security, and rights. It is incorporated by reference for explanatory purposes. If these Terms conflict with the Privacy Policy about personal-information handling, the Privacy Policy controls to the extent required by law.
You acknowledge the disclosed retention of the newest 100 completed text transcripts, reports, optional profile details, session hashes, abuse-prevention data, and operational logs. Video and audio are not currently recorded by the platform.
8. Availability, changes, and third parties
The service may be modified, rate-limited, suspended, interrupted, or discontinued at any time, including for maintenance, security, legal, capacity, or financial reasons. We do not guarantee a minimum uptime, number or quality of users, successful match, message delivery, media quality, compatibility, or preservation of content.
Third-party infrastructure, email, browsers, networks, certificate authorities, fonts, and peer devices are outside our complete control. Their terms and privacy practices may apply. Links or references do not constitute endorsement.
9. Enforcement and termination
We may warn, disconnect, restrict, suspend, revoke sessions, preserve records, block technical identifiers, or refer matters to appropriate authorities when we reasonably believe it protects users, the service, our rights, or compliance with law. We may act without advance notice where notice could create risk or compromise an investigation.
You may stop using the service at any time. Provisions concerning retained records, licences necessary for lawful retention, safety, disclaimers, liability, indemnity, disputes, and general interpretation survive termination where their nature requires.
10. Disclaimers
To the maximum extent permitted by applicable law, the service is provided “as is” and “as available.” We disclaim implied warranties and conditions of merchantability, fitness for a particular purpose, title, non-infringement, uninterrupted operation, accuracy, and security.
We do not conduct background checks, continuously monitor conversations, or guarantee that users are students, adults, safe, truthful, compatible, or law-abiding. You are responsible for your interactions and decisions. Nothing in these Terms excludes warranties or rights that cannot lawfully be excluded.
11. Limitation of liability
To the maximum extent permitted by law, toblues and its operator, personnel, contractors, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages; lost profits, opportunities, data, goodwill, or reputation; or harm arising from another user, off-platform conduct, unauthorized recording, service interruption, or third-party systems.
Where liability cannot be excluded, aggregate liability arising from the service will be limited to the greater of CAD $100 and the amount you paid to use the service in the twelve months before the event. This limitation does not apply to fraud, wilful misconduct, gross negligence, or other liability that applicable law prohibits us from limiting. Some jurisdictions do not permit certain exclusions, so they apply only to the lawful extent.
12. Indemnity
To the extent permitted by law, you will indemnify and hold harmless toblues and its operator from third-party claims, losses, and reasonable costs arising from your unlawful content, violation of another person’s rights, misuse of the service, or material breach of these Terms. We will provide reasonable notice and permit reasonable participation in the defence. This obligation does not require indemnification for our own unlawful conduct.
13. Governing law and disputes
These Terms are governed by the laws of Ontario and the federal laws of Canada applicable there, without regard to conflict-of-law rules. Subject to rights that cannot be waived, courts located in Toronto, Ontario have exclusive jurisdiction.
Before filing a non-urgent claim, contact toblues@noonmatches.com with a description and requested resolution and allow 30 days for an informal response. This does not prevent urgent injunctive relief, a privacy complaint to a regulator, a report to law enforcement, or use of a statutory process.
14. General terms
- Entire agreement: These Terms and referenced policies are the agreement about the service, replacing prior statements on the same subject.
- Severability: An unenforceable provision will be limited or removed only as necessary; the remainder continues.
- No waiver: Delay in enforcement is not a waiver.
- Assignment: You may not assign your rights without consent. We may assign the agreement as part of a legitimate reorganization or transfer, subject to applicable privacy law.
- No agency: These Terms do not create employment, partnership, fiduciary, franchise, or agency relationships.
- Interpretation: Headings aid readability. “Including” means “including without limitation.”
- Changes: We may update these Terms. Material changes will receive reasonable notice. If you disagree, stop using the service. New sensitive data uses remain subject to consent requirements.
